Terms of business

These terms apply to every quote, project and order with RJE Creative, alongside your quote (and, for larger projects, your project agreement). If anything in your quote or agreement differs from these terms, the quote or agreement applies. Version 1.0, October 2026.

1. About us

RJE Creative is the trading name of [Owner name], a sole trader. Address: [Address for documents]. Email: enquire@rjecreative.co.uk. We are not VAT registered.

2. Business and consumer customers

Most of our customers are businesses. If you are buying for personal use, you are a consumer and some of these terms work differently for you; where they do, we say so. Nothing in these terms affects your legal rights as a consumer.

3. Quotes and how a contract is made

  • Every quote is personal, based on the hours your brief needs, and valid for the period shown on it (normally 30 days). Prices shown are the total you pay.
  • The quote is the cap. If the work takes us longer than quoted, the extra time is on us. The only exception is a significant change to the brief, which we will always agree with you in writing first.
  • A contract is made when you accept a quote in writing, by email or through your project portal. For larger projects we also ask you to sign a short project agreement before work starts. Accepting online with your typed name is a valid signature.

4. Changes to the work

If you would like something added or changed, we will quote the extra hours first. Work on the change only starts once you approve it.

5. Payment

  • Payment stages are set out in your quote. Website and software projects normally start with a 50% deposit. Print orders are normally paid in full before printing.
  • Invoices are due within the number of days shown on them (normally 14).
  • If an invoice is overdue, we will remind you first and may pause work until it is paid.
  • Business customers only: we may also claim statutory interest and fixed compensation on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

6. What we need from you

Accurate content, materials and feedback on time. You confirm that you have the right to use anything you send us (text, photos, logos, fonts). Delays on your side may move the timeline but never increase the quoted cap. If a project is on hold waiting for you for more than 60 days, we may invoice for the work completed so far.

7. Our standards

We carry out all work with reasonable care and skill, and deliver what your quote describes. If something we did is not right, tell us and we will put it right promptly.

8. Web design and software

  • Up to 3 rounds of revisions are included before going live, unless your quote says otherwise.
  • Your site is built on a private preview copy. We move it to your live domain once you approve it and the go-live invoice is paid.
  • We fix faults in our own work reported within 30 days of go-live at no charge. Hosting, care plans and later changes are agreed separately.

9. Graphic design

Your quote states how many design concepts and rounds of changes are included. We supply the final approved artwork in files ready for screen and print.

10. Who owns the work

  • Once you have paid in full, you may use the final design, artwork, website content and custom code we created for you, for any purpose, for ever, and nobody else may use them without your permission. If you would like the copyright formally transferred to you, we will sign a written assignment at no cost.
  • Draft concepts you did not choose, and our own reusable tools and code (including Site Controls), stay ours. You may use Site Controls for as long as you use the website it was built for.
  • Third-party items (WordPress, plugins, fonts, stock images, booking platforms) remain under their own licences.
  • We only show your project in our portfolio or social media with your permission.

11. Printing

  • We send a proof for every print job. Please check it carefully: we print exactly what you approve, and we are not responsible for mistakes in a proof you approved.
  • Colours can vary slightly between screens and print, and between print runs. This is normal and is not a fault.
  • Quantities can vary by up to 5%, as is normal in the print trade. If we deliver fewer than you ordered, we will refund the difference.
  • Delivery dates are estimates. We will tell you straight away if one changes.
  • Please check your order when it arrives and tell us about any fault within 7 days if you are a business. If the fault is ours, we will reprint or refund. Consumers keep their full legal rights for faulty goods.

12. Your right to cancel (consumers)

  • If you are a consumer and accept a quote at a distance (online, by email or by phone), you can cancel within 14 days without giving a reason. For services the 14 days start when you accept the quote; for goods, when they are delivered.
  • If you ask us to start work within those 14 days and then cancel, you pay for the work done up to the point you tell us. Once the work is fully completed at your request, the right to cancel ends.
  • The right to cancel does not apply to items made to your specification or clearly personalised, such as printed wedding stationery, once we have started making them.
  • To cancel, email enquire@rjecreative.co.uk with your name and quote reference. We will refund any money due within 14 days, using the same payment method.

13. Ending a project

Either of us can end a project in writing. You pay for work completed up to that point, never more than the quoted cap, and we hand over everything you have paid for. If we end a project without good reason, we refund anything you have paid for work not done. Print orders cannot be cancelled once printing has started, except under section 12.

14. Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
  • Business customers: our total liability for a project or order is limited to the amount you paid for it, and we are not liable for loss of profit, revenue or data, or other indirect losses.
  • Consumers: we are responsible for loss you suffer that was a foreseeable result of us breaking these terms or not using reasonable care and skill.
  • We are not responsible for problems caused by third-party services outside our control (for example hosting outages, payment providers or booking platforms), or by changes made to a website by anyone other than us.

15. Confidentiality and your data

We keep your business information confidential and handle personal data in line with UK GDPR and our privacy policy. Where we process personal data on your behalf (for example enquiries or bookings on your website), we do so only on your instructions, keep it secure, and delete or return it when our work ends.

16. Complaints

If you are unhappy with anything, please email enquire@rjecreative.co.uk. We will reply within 5 working days and do our best to put things right.

17. General

We may update these terms from time to time; the version in place when you accept a quote applies to that project. These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
